Legal Thinking as an International Private Standard of the Law (June 22, 2016).

Available at SSRN:

Summary: Legal thinking is human thinking where it is not always clear where the public boundary ends and the private begins. Every time legal thinking is expressed in the singular and is accepted at public level, one is permitted to talk about a private standardisation of the law. Whether developed at local, national or international level, the phenomenon is not profoundly different. The same vigilance is always required. A standard is a simplification construed when dealing with the complexity of the law, confining it to its implementation phase.
